Privacy Policy
Last updated: October 20, 2026
This Privacy Policy explains how 805 Night Market ("we," "us" or "our") collects, uses and shares personal information when you visit our website (the "Site"), sign up for updates, buy tickets or attend our events. It also explains the rights California residents have under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA").
1. What personal information we gather
Depending on how you use the Site and our Events, we may gather these categories of personal information:
- Identifiers and contact details: such as your name, email address and phone number, when you sign up for email or text updates, contact us, or apply to be a vendor.
- Commercial information: such as the tickets you buy. Tickets are sold through Eventbrite, which processes ticket payments. Some on-site or other payments may be processed by Square. We do not receive or store full payment card numbers.
- Vendor application details: such as your business name, contact details, the products you sell and other information you include in your application.
- Internet and device activity: such as pages viewed, links clicked, device and browser type, approximate location based on IP address, and referring website, collected through cookies, pixels and similar technologies (see our Cookie Policy).
- Audio and visual information: photos and video recorded at our events, as described in our Ticket Terms.
We do not knowingly collect sensitive personal information as defined by the CCPA, and we do not use or disclose sensitive personal information for purposes that would give you the right to limit it.
2. Where we get it
We collect personal information directly from you, automatically when you use the Site, and from our service providers, such as Eventbrite when you buy a ticket.
3. How we use it
- To run our events, sell and manage tickets, and provide customer support.
- To send you email and text updates you signed up for, such as event announcements and ticket alerts.
- To review vendor applications and communicate with vendors.
- To measure and improve the Site and our marketing, including advertising on social media and other platforms.
- To keep our events and the Site safe and secure, and to comply with the law.
4. Text messages
If you give us your phone number and agree to receive texts, we will send recurring automated marketing text messages to that number. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to cancel or HELP for help. We do not sell or share your phone number or text-message opt-in consent with third parties for their own marketing.
5. Who we disclose it to
- Ticketing and payments: Eventbrite (ticket sales and ticket payments) and Square (payments).
- Service providers: companies that help us run the Site, our sign-up forms, email and text messaging, customer records and hosting. They may use personal information only to provide services to us.
- Advertising and analytics partners: we use, or plan to use, the Meta Pixel, the TikTok Pixel and Google Analytics, managed through Google Tag Manager. These tools collect information about your activity on the Site to measure ads and to show you relevant ads on other platforms.
- Legal and safety: when required by law, or to protect the rights and safety of our guests, vendors, team or others.
- Business transfers: as part of a merger, sale or other transfer of our business.
6. "Selling" and "sharing" under the CCPA
We do not sell personal information for money. However, using advertising pixels and cookies (such as the Meta Pixel and TikTok Pixel) to show you ads on other platforms may count as "selling" or "sharing" for cross-context behavioral advertising under the CCPA. In the past 12 months, the categories that may have been sold or shared this way are identifiers (such as cookie IDs and IP address) and internet and device activity, disclosed to advertising and analytics partners. You can opt out at any time on our Do Not Sell or Share My Personal Information page. We honor Global Privacy Control (GPC) browser signals as a valid opt-out. We do not knowingly sell or share the personal information of consumers under 16.
7. How long we keep it
We keep personal information only as long as we need it for the purposes described in this policy. For example, we keep sign-up details until you unsubscribe or ask us to delete them, and ticket and vendor records as long as needed for our events, our business records and legal requirements. Then we delete or de-identify it.
8. Your California privacy rights
If you are a California resident, you have the right to:
- Know and access the personal information we have collected about you, including the categories, sources, purposes and who we disclose it to.
- Delete personal information we collected from you, subject to legal exceptions.
- Correct inaccurate personal information.
- Opt out of the sale or sharing of your personal information.
- Not be discriminated against for exercising these rights.
To make a request, email support@805nightmarket.com with the subject "California Privacy Request." We will need to verify your identity, usually by matching information you give us with information we already have. You may use an authorized agent to make a request for you; we may ask for proof that the agent is authorized and ask you to verify your identity. We will respond within the time required by law.
9. Children
The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us personal information, contact us and we will delete it.
10. Security
We use reasonable safeguards to protect personal information. No method of transmission or storage is completely secure.
11. Changes
We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page shows when it last changed.
