These Terms of Service ("Terms") govern your use of the 805 Night Market website (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Using the Site

You may use the Site for your personal, non-commercial use. You agree not to misuse the Site, including by trying to access it in ways we did not intend, interfering with its operation, scraping it at scale, uploading harmful code, or using it for anything unlawful.

3. Tickets and events

Tickets are sold through Eventbrite and are subject to our Ticket Terms and Conditions and to Eventbrite's terms. Event details on the Site, including dates, venues, hours, vendors and performers, can change. Please check the Event page and your ticket confirmation before you go.

4. Vendor applications

Submitting a vendor application does not guarantee a spot at any Event. Vendor participation is subject to our review and to separate vendor terms.

5. Sign-ups and messages

If you sign up for email or text updates, you agree to receive marketing messages from 805 Night Market at the contact details you provide. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to cancel text messages, or HELP for help. You can unsubscribe from emails at any time with the link in the email.

6. Our content

The Site and its content, including our name, logos, photos, videos, text and design, belong to 805 Night Market or our licensors and are protected by law. You may not copy, change or reuse them without our written permission, except to share links to the Site.

7. Third-party links and services

The Site links to services we do not control, such as Eventbrite, Square, social media platforms and form providers. Your use of those services is governed by their own terms and privacy policies.

8. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties of any kind about the Site, including that it will be accurate, uninterrupted or error-free.

9. Limitation of liability

To the fullest extent allowed by law, 805 Night Market will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site. Nothing in these Terms limits any liability that cannot be limited under California law.

10. Governing law

California law governs these Terms. Conflict-of-law principles that would apply another state's law do not apply.

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
